Qualcomm filed suit with US ITC to ban imports of infringing Apple iPhone

【Global Network Technology Reports】July 6, 2017, San Diego--Qualcomm Incorporated (Nasdaq: QCOM) today announced that it has filed a lawsuit with the United States International Trade Commission (ITC) accusing Apple of illegally importing and selling six violations of Qualcomm. One or more claims in the patent for the iPhone, these six patents cover the key technologies that support important functions in the iPhone. Qualcomm requested the US International Trade Commission to investigate Apple’s infringement of imports and eventually issue a limited exclusion order prohibiting the import of relevant iPhones and other products to the United States to stop Apple’s illegal and unfair use of Qualcomm technology. Qualcomm's limited exclusion order seeks only for iPhones that do not use cellular baseband processors supplied by Qualcomm affiliates. In addition, Qualcomm also requested an injunction to prohibit the continued sale of imported Apple Inc. Infringing Products and to cease all marketing, advertising, display, and warehousing activities in the United States related to the sale and use of these imported products.

Don Rosenberger, Qualcomm’s executive vice president and general counsel, said: “Qualcomm's invention is at the core of every iPhone, and these inventions cover far more than modem technology or cellular mobile communication standards. The Qualcomm portfolio includes Thousands of patents, the patents that we advocate this time represent six important technologies, each of which is essential to the functionality of the iPhone. Apple’s use of Qualcomm’s technology on a continuous basis has refused to do so. The cost of the action is to stop Apple’s infringement of our six patented technologies."

The patents for these six U.S. Patents are: 8,633,936, 8,698,558, 8,487,658, 8,838,949, 9,535,490, and 9,608,675. These six patented technologies enable smart phones to extend battery life while achieving high performance, and each of these patented technologies achieves these effects in different ways for different common functions in smartphones. Although the technologies covered by these patents are critical to the performance of the iPhone, these six patents involved are not necessarily required for any standards implemented in mobile terminals, nor are they subject to any licensing commitments.

Qualcomm also filed a lawsuit against Apple Inc. in the Federal District Court for the Southern District of California, the same day, accusing Apple of violating the same six patents that Qualcomm filed with the US International Trade Commission. In the lawsuit, Qualcomm also requested damages and injunctive relief.

Qualcomm expects that the investigation of the US International Trade Commission will begin in August and will begin trial next year.
