Article 2 This measure is applicable to the State Electricity Regulatory Commission and its dispatched agencies (hereinafter referred to as the power regulatory agencies) for the installation (repair, test) of power installations, power generation companies, transmission companies, and power supply companies, etc. to comply with installation (repair, test) ) Supervision and management of the electric power facility permit system.

Article 3 The State Electricity Regulatory Commission (hereinafter referred to as the Electricity Regulatory Commission) is responsible for guiding, supervising, and coordinating the supervision and administration of the installation (rehabilitation, test) of power installation permits (hereinafter referred to as licenses) throughout the country.

The agencies dispatched by the SERC (hereinafter referred to as the dispatched offices) are responsible for the supervision and administration of licenses in their jurisdictions, and severely investigate and punish irregularities according to law. Major situations and problems should be promptly reported to the SERC.

Article 4 The dispatched agency shall perform the functions of supervision and administration of licenses by verifying the off-site supervision methods of the annual self-inspection materials, information submission and analysis, and the necessary on-site supervision methods for the installation (repair, trial) of power installation units.

Article 5 The dispatched agency shall supervise and administer the conditions of the unit that obtains the permit to continue to meet the statutory conditions of the license.

If the registered capital, net assets, equipment, production and business establishments, employees, etc. of the obtaining license unit have changed, and the statutory conditions for the license are not met, the dispatched office shall order it to rectify within a time limit and shall review the rectification. If it does not change within the prescribed time limit, the dispatched organization shall re-approve the type and grade of the license according to its actual conditions; if it does not meet the statutory conditions for the lowest level of the license, it shall revoke the license and go through the formalities for cancellation of the license in accordance with the regulations.

Article 6 Where the installation (repair, test) of a power installation entity applies for a license extension period in accordance with the regulations, it shall file an application 30 days before the expiry date of the validity period. The dispatched organization shall conduct a review in accordance with law and shall, in accordance with the following provisions, decide whether to grant a continuation before the validity period of the license expires:

(1) If the statutory conditions for a permit are met, the dispatched office shall make a written decision granting continuation in accordance with the law, and the effective date of the permit begins on the next day after the expiration date of the original permit;

(2) Where the statutory conditions for the permit are not met, the dispatched office shall make a decision not to continue according to law and notify the unit in writing. The notice shall state the reasons for not continuing.

A unit that has not been granted a continuation of the validity of the permit may reapply for a permit. Re-apply for licenses should be renumbered.

Article 7 If the period of validity of a permit fails to apply for continuation in accordance with regulations, or if the continuation application is not approved, the dispatched office shall go through the formalities for cancellation of the license in accordance with the provisions.

Article 8: The dispatched office shall supervise and administer the acts of illegally transferring licenses for installation (repair, trial) electric power installations. No unit or individual may illegally transfer the license in any way.

If a dispatched organization finds that an installation (repair, trial) electric power installation unit has one of the following circumstances, it shall investigate and verify the existence of illegal transfer of licenses:

(1) The subcontracting of the installation (repair, test) electric facilities business contracted by it is not carried out in accordance with law. The project manager, project manager, technical manager, financial manager, quality manager, and safety manager of the project management agency established at the construction site Personnel, etc. are not members of the unit;

(2) There is no asset property right relationship or a unified financial accounting relationship between the actual construction person on the construction site and the successful bidder or the construction unit agreed in the construction contract;

(3) Others suspected of illegally transferring licenses.

Article 9: A dispatched office shall subcontract (repair or test) electric power installation units whether subcontracting (repairing or testing) electric power installation services to other units or individuals or subcontracting them to obtain no licenses or exceed the scope of licenses. Supervision and management of the units and individuals.

Where an installation (repair or trial) electric power installation unit has one of the following circumstances, the dispatched office shall investigate and verify whether there is any violation of the permit system:

(1) After the subcontracting, the project management organization and the corresponding management personnel were not set up on the construction site, and the construction activities were not organized and managed;

(2) Submission of the contracted installation (repair, test) power facilities business to other units or individuals in the name of labor subcontracting;

(3) Others suspected of violating the licensing system.

Article 10 The dispatched office shall supervise and administer the installations (repairs and trials) of electric power installation units engaged in the installation (repair or trial) of the branches of electric power facilities.

(1) A subsidiary that carries out (repairs or tests) a power facility unit engages in the installation (repair, test) of electric power installation activities, and shall apply for a license independently and engage in the installation (repair, test) of electric power installation activities in its own name. ;

(2) Where a branch company that undertakes installation (repair or trial) of an electric power installation unit engages in the installation (repair, trial) of electric power installation activities, it shall file a record in accordance with the provisions of these Measures. The registered branch company may engage in the installation (repair, trial) of electric power installation activities in the name of the head office, and the head office shall bear corresponding legal liabilities.

Article 11 An installation (repair, test) electric power installation unit that establishes a branch of an electric power installation for carrying out repairs (repairs or tests) shall, within 30 days from the day when the administrative department for industry and commerce handles the relevant registration formalities, The offices of the company where the unit is located and where the branch is located should be filed with the following documents:

(1) A copy of the business license of a corporate legal person or a copy of a corporate legal person certificate, a copy of the permit, and a copy of the copy of the business license of the branch company;

(2) the articles of association of the company or the documents of the branch company;

(3) A newly established branch company after the implementation of the Measures shall provide proof of the establishment of funds for the establishment of the branch by the entity; a branch company that has been established before the implementation of these Measures but has not filed for the case, and provides a report that reflects the financial status and operating results of the branch company. (6) Other materials requested by the dispatched agency.

After the installation (repair, trial) electric power facility unit records the branch company established outside the jurisdiction of the issuing institution that issued the license, the branch company is engaged in the installation (repair, test) of the electric power installation activity within the filed area of ​​the dispatched office of the record. Report to the dispatched agency.

For branches that have been established before the implementation of these Measures but are not filed, the time for filing them shall be specified by the dispatched agency.

Article 12 If an installation (amendment, trial) electric power facility unit changes or cancels a branch engaged in the installation (repair or trial) of an electric power facility, it shall follow the procedures set forth in the preceding article to the local company's location and the changed or cancelled branch company. The local dispatch agency records and submits the following materials:

(1) If the branch is changed, a copy of the copy of the business license of the branch company after the change is submitted;

(2) If the branch is cancelled, a copy of the certification document issued by the administrative department of industry and commerce for granting cancellation of registration to the branch company shall be submitted;

(3) Other materials requested by the dispatched agency.

Article 13 The dispatched office shall supervise and administer the conditions for the installation (repair, trial) of electric power installation units to comply with the electric network entry operation permit system.

Article 14 An installation (repair, trial) electric power installation entity shall carry out self-inspection of its own compliance with the permit system, etc. in accordance with the regulations of the issuing authority issuing the permit, and submit it annually in the form of electronic information or paper materials. material:

(i) Self-inspection reports;

(b) a copy of the permit;

(3) A copy of the business license of a corporate legal person or a copy of a corporate legal person certificate;

(4) To set up a branch company engaged in the installation (repair or test) of electric power facilities, provide the consolidated annual financial statements of the unit and its branch companies, and a copy of the copy of the industrial and commercial business license of each branch company;

(5) Other materials requested by the dispatched agency.

The unit responsible for the installation (repair, trial) of electric power facilities shall be responsible for the authenticity and completeness of the submitted materials, and shall not provide false materials or conceal the relevant conditions.

Article 15 The self-inspection report submitted by the installation (repair, test) electric power installation entity shall include the following contents:

(1) Changes in the financial status, registered capital, equipment, production and business establishments, and employees of the company;

(2) Installation (repair, test) of power facilities activities, subcontracting of operations, establishment of project management agencies at construction sites, cross-district operations, etc.;

(3) Complying with the electrician's network entry permit system;

(4) Comply with the state's regulations on safety production management, and related electric power technologies, safety, quotas, and quality standards;

(e) Other relevant circumstances.

The self-examination report shall include relevant information on the branch company engaged in the installation (repair or trial) of electric power facilities.

Article 16 The dispatched agency conducts a random inspection of the authenticity and completeness of the materials submitted by the power installations for installation (repair, trial) according to the prescribed procedures.

Article 17 Where an installation (repair, test) electric power installation unit fails to submit annual self-inspection materials in accordance with the provisions of the dispatched organization, the dispatched organization shall order it to make corrections within a time limit. If there is no change within the time limit, the dispatched institution shall make an announcement to the public and impose an administrative penalty in accordance with the law.

Article 18 The dispatched office shall strengthen the supervision and inspection of the following conditions for the installation (repair, test) of electric power facility construction sites:

(1) Whether the construction site's actual construction person is consistent with the successful bidder's unit or the construction unit as stipulated in the construction contract, whether he obtains a permit and practices within the permitted scope;

(2) Whether there are circumstances that allow other units or individuals to engage in the installation (repair, trial) of electric power installation activities in the name of their own units;

(3) Whether it is subcontracted to subcontract (repair, test) electric power installation business to other units or individuals, or sub-contracted to units or individuals that have not obtained a permit or beyond the scope of the permit;

(4) Whether it is engaged in the installation (repair, trial) of electric power installation activities across regions, whether it reports to the dispatching agency of the project location in accordance with regulations;

(5) Whether the branch company is engaged in the installation (repair, trial) of electric power installation activities, whether it is filed according to the regulations;

(6) Whether all the personnel operating on the users' power receiving and transmitting devices have obtained the electrician's network operation permit and registered in accordance with the regulations;

(7) Comply with the state's regulations on safe production management;

(8) Other matters that require on-site inspection.

Article 19: A dispatched institution shall take the following circumstances as the target of spot check:

(1) Accidents or production safety accidents involving engineering quality accidents;

(2) being complained or reported by others to the power regulatory agency;

(3) Frequent changes in personnel in key positions such as technology and safety personnel;

(4) Failing to submit annual self-examination materials in accordance with regulations;

(5) Other circumstances that the dispatched agency believes should check.

Article 20 The dispatched office shall, in light of the examination of the annual self-examination materials and other routine supervision and management, carry out the conditions for the installation (repair, test) of electric power installation units to comply with the permit system, the state's safety production management regulations, and other relevant regulations. Annual comprehensive evaluation, and record the evaluation times on the license copy.

If the annual comprehensive evaluation is good or general, the supervisory inspection stamp and evaluation shall be stamped on the copy of the permit, and a copy of the permit shall be returned; if the annual comprehensive evaluation is inferior, the order shall be ordered to be rectified. Article 21 The dispatched office shall record the annual comprehensive evaluation of the installation (repair, test) power facility unit in its license credit file.

Article 22 Power generation enterprises, transmission enterprises and power supply enterprises shall improve the construction management system, project subcontract management system and production management system, and regard the permit as a necessary condition for carrying out installation, repair or commissioning of power facilities. In the bidding document for business, the bidder must obtain a corresponding permit; the installation (rehabilitation, trial) of electric power facilities business must not be contracted to units or individuals that have not obtained a license or have exceeded the license scope.

Article 23 The power supply enterprise shall improve the user engineering filing system, and shall inform the user in the application for power use of power users that the user is required to entrust the entity that has obtained the corresponding permit to engage in the construction of the power receiving facility; the inspection obligation shall be strictly performed and the user shall receive power. The intermediate inspection and completion inspection of the project will check whether the construction unit has obtained the permit and practices within the scope of the permit.

Article 24 If a dispatched organization finds that there is any illegal or irregularity in the installation (repair, test) of power installations, power generation enterprises, transmission enterprises, and power supply enterprises, it may order it to correct on the spot or rectify within a time limit; if an administrative punishment is required according to law, In accordance with the relevant provisions to make processing decisions.

The unit that has been ordered to make rectification shall carry out rectification according to the requirements, and shall send a written report on the rectification situation to the agency within 10 days from the expiration of the rectification period; the dispatched agency shall decide whether or not to review the rectification situation.

If the rectification is not carried out as required, the dispatched agency may interview its responsible person; if the circumstances are serious, the dispatched organization will make a public criticism of the unit and handle it according to law.

Article 25 Installation (repair, trial) of electric power installation units violate the provisions of these Measures by subcontracting (repairing, testing) the electric power installation business to other units or individuals, or subcontracting to those who have not obtained a permit or exceed the permit. Where units or individuals within the scope of the license are permitted, the agencies dispatched by the construction site shall give public criticism.

Article 26 If an installation (repair or test) electric power installation unit violates the provisions of these Measures and fails to record the branch company engaged in the installation (repair, test) of electric power installation activities, the installation (repair, test) of electric power facilities shall be carried out. The dispatched office of the place where the unit is located shall be ordered to make corrections within a time limit; if it is not overdue, the dispatched office where the power installation unit is located (repaired, tested) will give a public criticism.

Article 27 If a power generation enterprise, a transmission enterprise, or a power supply enterprise violates the provisions of these Measures, and one of the following circumstances occurs, the dispatched institution shall give a circular for criticism:

(1) The business units that undertake installation, maintenance or commissioning of power facilities shall be undertaken by units or individuals that have not obtained a permit or have exceeded the scope of the license;

(2) Where the inspection obligation is not fulfilled, the user's electricity-receiving project shall be borne by the unit or individual who has not obtained the license or surpassed the license scope.

Article 28 Where an installation (repair, trial) electric power installation unit commits an illegal act in violation of the jurisdiction of a dispatched institution that issues a permit, the dispatched office of the place where the activity occurs shall be dealt with in accordance with the relevant regulations, and the illegality and non-compliance shall be dealt with. The result is a copy of the issuing authority that issued the permit.

If it is necessary to make a reduction in the level of licenses, change the processing of license types, and require the cancellation of licenses, the issuing agency issuing the licenses will make decisions and implement them.

Article 29 A dispatched agency investigates and punishes illegal acts such as forgery, alteration, and reselling licenses. If any illegal act is found to be suspected of committing a crime and criminal responsibility is required to be investigated according to law, it shall be in accordance with the Provisions on the Transfer of Suspected Criminal Cases by Administrative Law Enforcement Agencies (State Council Order No. 310). Article 30 For a permit that should be written off, the entity that obtains the permit fails to go through the formalities for cancellation in accordance with regulations, and the dispatched office may cancel it through an announcement. At the expiration of 30 days from the date of publication of the announcement, the license is deemed cancelled.

Article 31 The supervision and inspection of licenses by electric power regulatory agencies shall not obstruct the normal production and business activities of the units being inspected, may not solicit or accept the property of the units being inspected, or seek other interests.

Workers of power regulatory agencies who abuse their power, neglect their duties, engage in malpractice for personal gains in the supervision and management activities of their licenses shall be given administrative sanctions in accordance with the law, and if they constitute a crime, they shall be investigated for criminal responsibility according to law.

Article 32 These Measures shall come into force as of the date of promulgation.
